1. Acceptance

By accessing or using PortfoMemo ("the Service"), operated at portfomemo.com and app.portfomemo.com, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PortfoMemo provides automated portfolio analysis. You submit portfolio holdings, and the Service generates a structured memo covering concentration, diversification, risk posture, and portfolio construction. The analysis is generated using AI and computational models.

3. Not Investment Advice

The Service is for informational and educational purposes only. Nothing produced by PortfoMemo constitutes investment advice, financial advice, trading advice, or any other form of professional advice. The analysis provided is a diagnostic tool, not a recommendation to buy, sell, or hold any security. You are solely responsible for your own investment decisions. Always consult a qualified financial advisor before making investment decisions.

4. Accounts

You must create an account to use the analysis features. You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account.

5. Purchases and Refunds

PortfoMemo offers one-time purchases of analysis credits. All purchases are processed by Stripe. Prices are displayed at the time of purchase and are charged in USD. Analysis credits do not expire.

Due to the digital nature of the Service, all sales are final. If you experience a technical issue that prevents delivery of a paid analysis, contact us and we will resolve it or issue a refund at our discretion.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to reverse-engineer, scrape, or extract the underlying models or algorithms.
• Resell, redistribute, or commercially exploit the analysis output without permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Create multiple accounts to circumvent usage limits.

7. Accuracy and Limitations

The analysis is generated by AI models and may contain errors, inaccuracies, or omissions. Portfolio analysis depends on the accuracy and completeness of the data you provide. We do not guarantee the accuracy, reliability, or completeness of any analysis. Past performance metrics, risk assessments, and scores are estimates and should not be relied upon as precise measurements.

8. Limitation of Liability

To the maximum extent permitted by law, PortfoMemo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or investment returns, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

9. Intellectual Property

The Service, including its design, code, models, and branding, is owned by PortfoMemo. You retain ownership of the portfolio data you submit. By using the Service, you grant us a limited license to process your data solely for the purpose of generating your analysis.

10. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time. Unused analysis credits are non-transferable and non-refundable upon termination.

11. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via the application or email. Continued use of the Service after changes constitutes acceptance of the updated terms.
